GENERALITIES: The terms of business specified in the following apply to all commercial relations between BEATEDELIC RECORDS and the customer. A contract for sale is only entered upon receipt by the customer of an e-mailed confirmation for the order he has placed with BEATEDELIC RECORDS. VAT–FREE PRICES: All articles listed on the website are VAT-free due to the status of this company as a small business. VAT (Sales Tax) is consequently not charged on purchases made at BEATEDELIC RECORDS. Prices are always as of the time an order is placed. PAYMENT: All transactions require advance payment. Payments can be made by credit card (Mastercard, Visa), Paypal or bank transfer (IBAN and BIC/SWIFT- code), the last only being possible from countries within the EU territory. In case bank transfer has been selected as the method of payment the customer will automatically receive an account and the requisite banking information via email. Payment must be made within 7 working days of billing. CURRENCY: All payments – irrespective of the method of payment selected must be made in Euro. SHIPMENT: The ordered goods are dispatched after receipt of payment. BEATEDELIC RECORDS is not liable for damage or loss of the shipment incurred due to inexpert handling of it on the part of the shipping company. DELIVERY CHARGES: Shipping and packing charges are borne by the customer and are shown separately on the invoice. They are determined and made explicit before a contract for sale is entered. DELIVERY: The ordered goods are consigned to the delivery address specified by the customer. All information concerning delivery periods is nonbinding. RESERVATION OF PROPRIETY RIGHTS: Ownership of the ordered articles rests with BEATEDELIC RECORDS until they have been paid for in full by the customer. WARRANTY: BEATEDELIC RECORDS trades in both new and used goods. The defects liability period for new articles is 2 years, that for used ones 1 year, starting in both cases at the time of delivery. Warranty covers defects the customer may detect on an article upon delivery. BEATEDELIC RECORDS is not liable for any damage sustained by an article after delivery. RIGHT TO WITHDRAW: The customer is entitled – without giving a reason for doing so – to return an article from the current range of products within 7 days of delivery. The redemption of opened (unsealed) CD’s, Vinyls, DVD’s etc. is not possible due to copyright reasons. The costs for returning an article are to be borne by the customer. The period allocated for the right to withdraw starts on the day the goods are delivered to the customer. In order to keep the term it suffices to give due notice of one’s intention to withdraw via letter or email. PROTECTION OF PRIVACY: In accordance with the requirements of the data protection act all data necessary for the handling of an order are stored and treated confidentially and are not forwarded to third parties. The exclusive responsibility for the contents of these pages rests with their respective operators. PLACE OF JURISDICTION: The court for any dispute arising from this contract is the competent court in Vienna/Austria. |
